These Terms of Service ("Terms") govern your use of floridafundingusa.com and the services of Florida Funding ("Florida Funding", "we", "us"). By using the website or submitting an application, you agree to these Terms and to our Privacy Policy.
1. Who we are
Florida Funding is a commercial financing broker. We help small-business owners prepare and submit requests for working capital, such as merchant cash advances, to third-party funding providers. We are not a lender, bank or financial institution, we do not fund any request and we do not make approval decisions.
2. Business use only
Our services are for businesses and their owners seeking commercial financing for business purposes. They are not for personal, family or household purposes. You must be at least 18 years old and authorized to act on behalf of the business.
3. No fee to you, no guarantee
- Florida Funding does not charge you any upfront or advance fee. We are compensated by the funding provider when a request is funded.
- Submitting an application does not guarantee approval, an amount, a rate or a timeline. Every request is subject to the funding provider's review, verification and approval.
- Any offer, its total repayment amount, payment method, term and costs are set by the funding provider and disclosed to you before you sign. You are never obligated to accept an offer.
- Merchant cash advances and similar products can cost more than traditional bank financing. Review the full terms and the total amount to be repaid before signing.
4. Your information and authorization
You agree to provide true, complete and current information and documents. By submitting an application you authorize Florida Funding to share it with funding providers, and you authorize them to obtain credit reports and verify the information, as described in the application and in our Privacy Policy. Providing false information may lead to denial and may violate law.
5. Communications
By giving us your contact information and checking the contact box, you agree that Florida Funding may contact you about your request by phone, WhatsApp, text message and email, including at the mobile number you provided. Message and data rates may apply. Reply STOP to stop text messages, or tell us at any time that you do not want to be contacted. Consent is not a condition to apply.
6. Acceptable use
You agree not to misuse the website, submit applications for a business you do not represent, upload malicious files, attempt to access data that is not yours, or interfere with the website's operation.
7. Website content
Content on this website is for general information about working capital and is not legal, tax or financial advice. Examples and descriptions are illustrative and are not offers. The Florida Funding name, logo and content belong to Florida Funding and may not be used without permission.
8. Third parties
Funding providers are independent companies with their own terms and privacy policies, which govern any agreement you sign with them. Links to third-party websites are provided for convenience; we are not responsible for their content.
9. Disclaimer and limitation of liability
The website and services are provided "as is" and "as available". To the fullest extent permitted by law, Florida Funding is not liable for decisions, offers, terms or actions of funding providers, or for indirect, incidental or consequential damages arising from your use of the website or services. Our total liability for any claim related to these Terms will not exceed one hundred U.S. dollars (US$100).
10. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Orange County, Florida, unless applicable law requires otherwise.
11. Changes
We may update these Terms. The new version will be posted on this page with a new effective date. Continued use of the website means you accept the updated Terms.
